Welcome to Cosmo’s website terms and policies. Please read through them carefully before placing your order. By using this website and/or placing an order, you agree to be bound by the terms and policies set out below. Before placing an order, if you have any queries relating to these terms and policies, please email us at enquiries@massagechair.sg. We may change our terms and polices from time to time without a public notice to you. Changes will apply to any subsequent orders received, once your order has been confirmed, we will not be able to make any changes.

General

This website, https://massagechair.com.sg/ is owned by Cosmo Pte Ltd. It is available for a user’s personal and non-commercial purposes only. Any use of the site or its contents, including copying or storing it or them in whole or part (book marking), other than for your own personal, non-commercial use is prohibited without the written permission of Cosmo Pte Ltd. User may not use, reproduce, redistribute or download any of site content, including all text, pictures, headers, designs, graphics, illustrations, images, icons, buttons, code and software, or any other content on this site for other purposes. User agrees to not copy nor publicly display any content belonging to Cosmo Pte Ltd on any network computer or broadcast the content in any media, nor modify or after the content in any way, or delete or alter any copyright notice.

Registration and Information
When you register to use our website or to purchase our products and services, you are required to provide us with your email, mailing address and other personal details. These personal details are required for us to manage and process and track your purchase. After registering with us, you will receive a password for your account. You must ensure that the username, password and the account are not made available to any third party. And, you are obliged to inform us immediately of any misuse of your username, password or account. In such cases, we may cancel your account at any time without giving reasons and we will deactivate or delete your account and all data saved. Please also refer to our Privacy Policy for information relating to the collection, storage, use and protection of your personal information by us.

Pricing Policy
The price of our products and services are subject to delivery costs and GST and shall be the price stated on our order form. Where no price is stated on our order form, the price shall be the price listed in our price list or website which shall be current at the date and time of your order.

Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. We will also reserve the right to change the price of the products and services at any time before delivery of the products and services to reflect any increase in the cost to us which may be due to factors beyond our control (for example, any foreign exchange fluctuation, currency regulation, alteration of import or other duties, increases in labour, materials or other manufacturing costs, changes in delivery dates, quantities or specifications for the products or services requested by you or any delay caused by any information or instructions given by you or a failure by you to provide us with any adequate information or instructions).

Also, the price for our products on our online store may or may not be at the retail counters.

We do not accept any liability for any discrepancy between the prices in our physical stores and online store. Also, from time to time, especially during sales or promotional periods, we may offer additional discounts for purchases online from www.massagechair.com.sg that does not apply to the physical stores or vice versa.

Delivery Terms
Have your order(s) sent straight to your doorstep with our appointed home delivery service provider within 24 hours.

Self-Collection (applicable for Singapore purchases only)
For self-collection, you can collect your order from COSMO’s Customer Care Centre at Vertex @ 33 Ubi Ave 3 #02-36 (S)408860, (Monday to Friday, except for Public Holidays), 11 am to 6 pm.
Please note that, you are required to provide IC verification as well as the purchase receipt.

For international delivery, all orders will be delivered by Fedex . You will be subjected to the international mail rates stated by Fedex as well as import taxes, custom duties and other fees related to international delivery.
Delivery should be acknowledged by you or your authorized recipient during the delivery on the invoice presented by the delivery personnel. You should ensure that an authorized recipient is present at the delivery address during the selected timeslot to receive the delivery, failing which, COSMO reserves the right to charge you a re-delivery fee for each subsequent trip.

Evidence of Delivery
Your order will be deemed to be delivered once we receive the authorised couriers’ delivery note/invoice which, when and howsoever signed as acknowledgement of receipt of the product and services, will be proof of delivery by us of the products and services specified therein.

Failure to take Delivery
If you fail to take delivery of the products and services or if you fail to give us adequate delivery information and instructions when placing your order with us, COSMO reserves the right to store the products ordered until actual delivery and charge you for the extra costs from the third delivery onwards.

Payment
The mode of payment for online purchases is strictly via PayPal. We shall issue receipts for all payments received by us. Time of payment of the price of the products and services shall be of the essence. The product will be sent out only after full payment has been received.

Cancellation
You may cancel your order immediately after it has been submitted, up to one (1) day before the scheduled delivery date. Once your order has been dispatched from the warehouse, we will not accept the cancellation of any products and services. Thereafter, it will be deemed as return product which you will receive a full refund of the merchandise ONLY (including applicable taxes); shipping and handling fee will not be refunded. All cancellations must be made by telephone, fax or email and must be supported by valid reasons. For the avoidance of doubt, the ability to source or obtain the same products and/or services specified in your order for a lower price shall not amount to a valid reason entitling you to cancel your order.

We shall also be entitled to cancel the purchase or suspend any further deliveries to you without any liability whatsoever, if you make any voluntary arrangement with your creditors or become bankrupt or become subject to an administration order or go into liquidation, have a receiver, liquidator or administrator appointed over any of your property or assets, cease, or threaten to cease, to carry on business, or if we reasonably believe that any of the above mentioned events is about to occur to you.

Returns
All products, once sold are non-returnable. However, exceptions will be made for wrong delivery or faulty products provided they are reported to Customer Service within 3 days upon acceptance of delivery. All such products must be returned to us in their original packaging within 7 days of receipt of goods for a full refund of the purchase price or for replacement of the product whichever applies. For products with installation and exhaustible parts, the cost for installation and exhaustible parts shall be bear by you. All returns must be accompanied with the sales invoice with the date of purchase and serial number clearly printed on it for verification. Return of products will only be at our office at Vertex @ 33 Ubi Ave 3 #02-36 (S)408860. Please note that we may request for you to email/send pictures of damaged or defective merchandise.

For overseas returns, you have to return the products and bear the return freight charges. Upon receipt of the products, COSMO will send the replacement product(s) via mail. Normal delivery lead time applies.

All returns are at your responsibilities until they reach our office.

Refund
We do not offer refunds for products lost during International Delivery as we have no control over the postal service in your country. Refunds of any monies for products and services ordered and/or cancelled are entirely within our discretion. In the event that we agree to refund any monies to you, the refund shall be made by us within 7 to 21 working days via the bank account information you have provided to us when registering. A refund of merchandise and taxes will be given however shipping and handling for the delivery and pick up will not be refunded.

Notwithstanding this, we reserve the right to charge you a flat fee of S$40 for the administrative, packing and delivery costs incurred by us in processing, preparing and delivering your order and subsequent refund.

Warranty Terms and Conditions
This warranty is valid for product installed and used in Singapore only and for the warranty period stated in the Operation Instruction/Invoice. The warranty period commences from the date of original purchase.

This product and all parts thereof are hereby guaranteed to the purchaser/user to be free from defects in material and workmanship. Eligibility for warranty coverage is limited to repair, or replacement of any parts (excluding consumable parts and accessories exhausted through usage that may be packaged or sold together from the Product) which proves to be defective within the applicable warranty period.

Please retain the original purchase receipt for verification purposes when required. To be eligible for warranty coverage, Product has to be registered by the original end-user purchaser/user within 14 days from the date of purchase.

Warranty coverage does not extend to damages and/or defects resulting from:

Accidents, abuse, misuse, improper installation, or any manner of tampering.
Usage of wrong electrical supply/voltage.
Usage note in accordance with the operation instructions manual.
Any unauthorized repairs.
Any alteration or modification made to the Product.
Normal usage wear and tear, finishes or consumables.
Corrosion, rusting or stains.
Improper transportation, inappropriate storage conditions or materials, improper ventilation, reconfiguration of the Product.
Losses, damages, defects and malfunctions caused by fire or acts of God.
This warranty does not apply/cover for:

Parts requiring replacement due to normal wear and tear, corrosion or stain.
Damage due to other equipment/solutions/accessories being used in conjunction with the covered Product.
Transportation, delivery and incidental cost incurred in fulfilment of this warranty. The purchaser/user shall be fully responsible for the due delivery of the Product for any repair work to COSMO and for the subsequent collection. Any Product to be repaired must be sent to the service centre directly. No outdoor servicing will be provided. COSMO can provide collection and return service and a transportation fee of S$30 is applicable.
To the fullest extent permitted by law, COSMO shall not be in any way liable for any consequential, incidental, direct, indirect damages whatsoever arising from or in connection with the use, inability to use or performance of the Product, including without limitation loss of reputation, failure to realise savings or other benefits, loss of use of the Product, loss of/or damage to other property due to the malfunction of the Product, costs of substitute equipment, loss due to downtime cost, costs of recovering. COSMO does not exclude or limit liability for personal injury or death.

Without limiting the generality of the foregoing, the purchaser/user assumes all risk and liability for loss, damage or injury to the purchaser/user and their property and to any third parties and their property arising out of the use, misuse or inability to use the COSMO product.

In the event that the Product is out of stock, obsolete or beyond repair, COSMO reserves all rights to replace the Product with another similar value as deem appropriate, subject to availability. In no event shall any recovery against COSMO exceed the actual price paid for the purchase of the Product.

This warranty will be invalidated and rendered void upon the usage of any non-original filters/parts/accessories that is not provided or approved by COSMO for use with the product.

This warranty is void if the serial number on the Product had been removed, erased, defaced, altered, tampered or is illegible.

Any replaced Product or part, or fully refunded Product, shall become the absolute property of COSMO and must be returned to COSMO.

COSMO reserves all rights to impose charges for services on the Product which are outside the perimeter of warranty coverage. COSMO also reserve the right to decline Product servicing where the Product is obsolete, no longer deemed serviceable or replaceable for any reason.

If any section, provision, clause, sentence or part thereof of this warranty is held to be void, invalid or unenforceable, it shall be modified necessarily to make it valid and enforceable, and it shall not in any way be affected or impaired thereby.

COSMO shall reserve the right to modify or change the terms and conditions herein due to change(s) in availability of Products and/or spare parts or for the purposes of complying with applicable policies, rules, regulations and law, without prior notice.

With the proceeding of the Product usage, it means the purchaser/user have read, understood and agreed on the COSMO’s warranty terms and conditions and also acknowledged that COSMO’s limitations of liability are reasonable and within the context and circumstances under which it is applied on.
